§ 1 Scope

(1) These General Terms and Conditions apply to all contracts concluded between BeNeon UG (haftungsbeschränkt) (hereinafter “we” or “us”) and consumers or traders (hereinafter “customers”) via the online shop besports-matratzen.de.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession (Section 13 of the German Civil Code, BGB).

(3) A trader is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their trade, business or self-employed profession (Section 14 BGB).

(4) Deviating or supplementary general terms and conditions of the customer shall only become part of the contract if we have expressly agreed to their validity in writing.

§ 2 Conclusion of contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.

(2) By clicking the “Buy now” (“Jetzt kaufen”) button, you submit a binding offer to conclude a purchase contract for the goods in your shopping cart.

(3) The contract is concluded upon our express order confirmation or, at the latest, upon delivery of the goods.

§ 3 Prices and payment terms

(1) All prices stated are final prices in euros and include statutory VAT.

(2) Any additional shipping costs are shown separately during the ordering process.

(3) Payment is due immediately upon conclusion of the contract, unless otherwise agreed.

§ 4 Payment methods

We offer the following payment methods:

  • Prepayment (bank transfer)

  • Credit card (Visa, Mastercard, American Express)

  • PayPal

  • SOFORT / Klarna

  • Apple Pay / Google Pay

  • Klarna Pay by invoice

  • Klarna Instalment purchase

If you choose a payment service provider (e.g. Klarna or PayPal), the terms and conditions of the respective provider also apply.

§ 5 Delivery and shipping

(1) Delivery is made exclusively within the Federal Republic of Germany (excluding islands).

(2) Within Germany, we deliver free of shipping costs.

(3) Partial deliveries are permitted insofar as they are reasonable for the customer and no additional costs arise.

§ 6 Retention of title

The goods delivered remain our property until paid for in full.

§ 7 Right of withdrawal for consumers

(1) Consumers have a statutory right of withdrawal for distance contracts.

(2) The complete withdrawal policy, including the model withdrawal form, is available on a separate “Right of withdrawal” (“Widerrufsrecht”) page on our website and becomes part of the contract.

(3) These General Terms and Conditions do not restrict the statutory right of withdrawal in any way.

§ 8 Voluntary right of return (“100-night sleep trial”)

(1) For BeSports mattresses, we grant consumers a voluntary contractual right of return of 100 days from receipt of the goods.

(2) This voluntary right of return applies exclusively to mattresses and not to accessories or other products such as slatted bed bases, pillows, fitted sheets or other soft goods.

(3) The details of the voluntary right of return, in particular regarding the return process, collection, allocation of costs and refunds, are set out in the separate information on our website.

(4) The voluntary right of return exists in addition to the statutory right of withdrawal and does not affect it.

§ 9 Statutory warranty

(1) The statutory warranty rights apply.

(2) For traders, the warranty period for newly manufactured goods is one year from the transfer of risk.

§ 10 Liability

(1) We are liable without limitation for damage resulting from injury to life, body or health, as well as in cases of intent and gross negligence.

(2) In cases of simple negligence, we are liable only for breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to the foreseeable damage typical for the contract.

(3) Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.

§ 11 Set-off and right of retention

The customer is only entitled to set-off if their counterclaims have been legally established or are undisputed.

§ 12 Choice of law and place of jurisdiction

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Berlin.

§ 13 Dispute resolution (Section 36 VSBG)

BeNeon UG (haftungsbeschränkt) is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
